Buying Or Selling A Used Car With An Outstanding Recall: The UK Dealer Rules, Real Prosecutions And What To Check Before You Pay

Recall data from DVSA, updated 15 October 2026.

A UK car dealer should fix any outstanding safety recall before selling a car to a consumer, and Trading Standards has prosecuted dealers who did not disclose them.12 Private sellers are not bound by the same rules. Check the registration for open recalls before you pay, and ask for the repair to be done first.

Dealers must fix safety recalls before selling to consumers. Private sellers don't have to. Check before you pay.

Can A Dealer Sell A Car With An Outstanding Recall?

DVSA says dealers, including online sellers, must fix safety recalls free of charge before selling cars to consumers. Trading Standards treats selling a car with a serious or stop-drive recall as a likely breach of product safety law.13

DVSA put it plainly in guidance published with Trading Standards: "By law, car dealers, including online sellers, must fix safety recalls free of charge before selling cars to consumers. Private sellers aren't bound by the same rules."1 Which? reports DVSA's view that selling a car with an outstanding recall is likely to breach the General Product Safety Regulations, including for used cars, and the Chartered Trading Standards Institute says a car with a serious recall or stop-drive warning should not be sold in that state and doing so may be an offence.3

For you as a buyer, that gives a simple position: a dealer should hand over the car with recalls done, and you can ask for proof. Our guide to whether car recalls are mandatory explains who must do what.

Real Cases: Dealers Fined Over Undisclosed Recalls

In 2025 a Luton dealership and its director were fined a total of £16,763 for selling cars without telling buyers about unresolved recalls.2

Case What happened Outcome
Jan Autos, Luton, 2025 Trading Standards warned the business in 2020. Seven vehicles were then found with undisclosed recalls between January and July 2022 Company fined £14,000 plus surcharge and costs; director fined £1,100 plus surcharge; £16,763 in total2
Car Mart Ltd, Luton, 2024 Advertised vehicles in 2022 and 2023 without mentioning outstanding recalls Fined £1,200 plus £120 surcharge and £2,500 costs; £3,820 in total4

These cases came from one council area, which shows how enforcement can follow a single local investigation. They also show that "it will be done at its next service" is not an answer a dealer should give.

Should You Buy A Car With An Open Recall?

Only if the recall is done before you pay, or the seller commits in writing to have it done, and it is not a stop-drive recall with no parts available.

Should I Buy A Car With An Open Recall?

The decision turns on four questions:

  • Who is selling? A dealer should fix the recall before the sale. A private seller does not have to, so the job may fall to you.1
  • How serious is it? A stop-drive recall means the car should not be driven away. See stop-drive recalls.
  • Are parts available? Some recalls run in phases, with long waits for parts.5
  • Is it in writing? If the repair cannot be done before you collect, get the seller's commitment in writing, with a date.

The repair is free for any owner, so an open recall is not a reason to pay less in itself.6 It is a reason to delay paying until the work is done or properly agreed.

How To Check A Used Car For Recalls Before You Buy

Check the registration here, match the VIN on the car to the V5C and check it with the manufacturer, look at the MOT history, and ask for the job card of any completed recall.

The four checks take a few minutes:

  1. Run the registration through our checker while you are with the car.
  2. Match the VIN. Compare the VIN at the base of the windscreen with the V5C, then ask the manufacturer's helpline or a franchised dealer to check it. See where to find your VIN.
  3. Read the MOT history. Since July 2023 it can show outstanding recalls for makers that share data.7 See what an outstanding recall means.
  4. Ask for paperwork. A completed recall should have a job card showing the campaign code.

Do not rely on a paid history check alone. When Which? looked at dealer-listed Citroën C3s, 12 of 16 had an outstanding recall, only 1 of 7 dealers who replied gave the correct status, and a paid check reported "All clear" on a recalled car.8 The free checks are more reliable for recalls.

Private Sellers, Auctions And Part-exchange

Dealers and online traders must fix safety recalls before selling to consumers. Private sellers do not have that duty but must not misdescribe the car, and at auctions you should ask whether the car was recall-checked.

Seller Recall duty What to do
Franchised dealer Must fix safety recalls before selling to a consumer1 Ask for the job card
Independent dealer Same duty1 Ask for proof and check the registration yourself
Online trader Same duty1 Check before the car is delivered
Private seller Not bound by the same rules1 Run every check yourself and ask directly about recalls
Auction No specific published rule found Ask the auction house whether the car was recall-checked

Asking a private seller a direct question in writing, such as "Has every manufacturer recall been completed?", is worthwhile. A false answer can help you later if the car was misdescribed.

Selling Your Car With An Outstanding Recall

Get the free recall repair done before you sell. If you sell privately, tell the buyer about any recall you know of.

Booking the work first is the simplest route: it costs nothing, it removes a question from the sale and it gives you a job card to show buyers.6 If you are part-exchanging with a dealer, the dealer will usually arrange the work before reselling the car. See are car recalls free for what the repair covers.

Does An Open Recall Affect The Car’s Value?

There is no reliable UK figure, but buyers and dealers increasingly check recalls, so an unfixed recall can slow a sale. Fixing it is free.

The free repair is the key point for both sides. A buyer who knows the recall can be done at no cost has little reason to cut the price for it alone, while a buyer who is unsure may walk away. For a seller, booking the repair before listing the car is the cheapest way to protect its value. A completed recall shows a well-kept car rather than a problem.

What To Ask The Seller In Writing

A short written exchange before you pay settles most recall questions. The questions worth asking are:

  • "Have all manufacturer safety recalls on this car been completed?"
  • "Can you show the job card or invoice for each one?"
  • "If a recall is outstanding, will you have it done before I collect the car, and by what date?"
  • "Is any recall on this car a stop-drive recall?"

Keep the replies, whether by email or text. They help if a problem appears after the sale, and they make the conversation about recalls a normal part of buying the car.

If you've already bought it

You Bought A Car And Then Found An Outstanding Recall

Book the free repair now. If a dealer sold it to you without disclosing the recall, contact the dealer first and use your Consumer Rights Act options.

Under the Consumer Rights Act 2015, you have a short-term right to reject faulty goods for 30 days from the day after ownership passes and the car is delivered, and that period pauses while a repair is awaited.9 An undisclosed recall on a car bought from a dealer is worth raising with the dealer straight away, in writing. If the dealer will not help, see what to do if a dealer refuses to fix a recall and car recall compensation.

Frequently Asked Questions

Can A Dealer Sell A New Car With An Open Recall?

New cars covered by a recall are normally held back by a stop-sale until they are fixed. See what a car recall means.

Does The History Check I Paid For Show Recalls?

Not always reliably. Which? found paid checks missing or mislabelling a recall, so use the free registration check too.8
